the8.ai provides a B2B contact data platform that allows users to search, access, and validate business contact information including email addresses, phone numbers, company data, and related business intelligence. Billing: Certain aspects of the Services are provided on a subscription basis. You will be billed in advance on a recurring monthly or annual basis, depending on the plan you select. Your subscription will automatically renew at the end of each billing period unless you cancel.
Credits: Some plans include a fixed number of contact credits per billing cycle. Unused credits do not roll over to the next billing period unless otherwise specified in your plan.
Price Changes: We reserve the right to modify our pricing at any time. Any price changes will take effect at the start of the next billing cycle following notice to you.
Refunds: Payments are non-refundable except where required by law. If you cancel your subscription, you will continue to have access to the Services through the end of your current billing period.
While we strive to provide the most accurate and up-to-date contact data possible, we do not guarantee the accuracy, completeness, or reliability of any data provided through our Services. Business contact information changes frequently, and despite our validation processes, some data may be outdated or incorrect. You acknowledge that you use the data at your own risk and agree to verify critical information independently before relying on it for business decisions.
The Services and their original content, features, and functionality are owned by the8.ai labs and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Services or included software, nor may you reverse engineer or attempt to extract the source code of that software.
If your subscription includes API access, you agree to use the API in accordance with our API documentation and rate limits. We reserve the right to throttle or suspend API access if we determine, in our sole discretion, that your usage negatively impacts the performance or availability of our Services for other users. API keys are confidential and must not be shared with unauthorized parties.
To the maximum extent permitted by applicable law, in no event shall the8.ai labs, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Services, any conduct or content of any third party on the Services, any data obtained from the Services, or unauthorized access, use, or alteration of your transmissions or content.
Our Services are provided on an "AS IS" and "AS AVAILABLE" basis without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance. We do not warrant that the Services will function uninterrupted, secure, or available at any particular time or location, or that any errors or defects will be corrected.
You agree to defend, indemnify, and hold harmless the8.ai labs and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Services, including any data or content transmitted or received by you.
We may terminate or suspend your account and access to the Services immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Services will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Delaware.
We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least 30 days' notice before the new terms take effect. What constitutes a material change will be determined at our sole discretion.
